HoiSum Terms of Service
Welcome to HoiSum. These Terms of Service (the "Terms") apply to the HoiSum website, platform, tools, features and related services (collectively, the "Service"). HoiSum is operated by TOMORROW CAPITAL HOLDING CO., LIMITED. Unless otherwise stated, "HoiSum", "we" and "the Platform" in these Terms refer to that operating entity and the HoiSum Service it provides.
By using, accessing, registering for or purchasing the Service, you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Service.
Section 1Service scope and applicability
1.1 HoiSum is an AI-powered self-service job-search management platform designed to help users organise job-search information, manage CVs and application materials, and track the application process.
1.2 The Service may include, without limitation: job-listing parsing, parsing the user's submitted résumé and saves it as your current master résumé, AI-assisted generation of application materials, application-pipeline management, saved roles and other features introduced from time to time. Available features are as displayed on the Platform at any given time.
1.3 HoiSum is a self-service tool platform. Unless expressly stated otherwise in writing on the Platform, HoiSum does not provide manual fulfilment, manual application submission, career consultancy, recruitment consultancy, headhunting, employer-agency or individualised employment-placement services.
1.4 HoiSum is not a recruitment intermediary, employment agency or employer's agent. It does not recruit, screen, recommend, hire, negotiate salaries or conduct background checks on behalf of any employer, nor does it make any commitment to employers on behalf of users.
1.5 HoiSum provides job-search assistance tools and does not guarantee that any user will receive interview invitations, job opportunities, employment offers, visas, salary packages or any other job-search outcome. Outcomes are affected by multiple factors including, without limitation, market conditions, employer preferences, recruitment processes, the user's own qualifications, the accuracy of information submitted and third-party platform policies.
1.6 The Service may generate analyses, summaries or suggestions based on publicly accessible job-listing information, third-party website content or data entered by the user. HoiSum does not guarantee the accuracy, completeness, timeliness, availability or continued accessibility of such third-party information.
Section 2Account registration and security
2.1 You may create and access an account through registration or sign-in methods made available on the Platform from time to time, including but not limited to email, verification code, password or third-party account sign-in. Available methods are as displayed on the Platform.
2.2 You must be at least eighteen years of age and possess the capacity to enter into a legally binding contract in order to register for and use the Service.
2.3 Each user may register and use only one account. You may not register for or use the Service under a false identity, another person's identity or with incomplete information.
2.4 You are responsible for safeguarding your account credentials and sign-in methods, and for all activity that occurs under your account. If you believe your account may have been compromised, used without authorisation or is at security risk, you should contact HoiSum promptly.
2.5 If HoiSum reasonably believes that any of the following circumstances exist, it may suspend, restrict or terminate the account or related features to the extent permitted by law:
- breach of these Terms or other applicable rules;
- use of false, misleading or incomplete information;
- sharing, transferring or permitting others to use the account;
- using automated tools, scripts, bots or other abnormal means to access or operate the Platform;
- circumventing, abusing or attempting to circumvent the Platform's quotas, limits, security measures or payment arrangements;
- posing a risk to the Platform, other users, third-party services or system security;
- the account has had no login activity for more than twelve months and HoiSum has, where reasonably practicable, notified the user.
2.6 Where there is a security risk, suspected illegality, serious misuse or potential for loss, HoiSum may take necessary action immediately without prior notice.
Section 3Plans, quotas and payment
3.1 HoiSum may from time to time offer a free plan and one or more paid plans. Plans may differ in feature scope, usage quotas, validity period, service limits and price. For example, a paid plan may include 100 AI-tailored application packages.
3.2 The specific plan name, price, features, quotas, validity period and other applicable limits shall be as displayed on the Platform's Pricing page, payment page or order-confirmation page at the time of purchase, and form part of these Terms.
3.3 Unless expressly stated otherwise on the Platform, paid plans do not auto-renew. When a paid plan expires, the account may revert to the free plan; user data will be retained or processed in accordance with the Platform's Privacy Policy and applicable feature rules, but available features will be subject to free-plan limits.
3.4 Payment is processed by a third-party payment provider. You may be required to comply with the applicable terms of that third-party payment service during the payment process. HoiSum does not directly store your full payment-card details.
3.5 HoiSum may from time to time adjust the price, features, quotas and limits of the free plan or paid plans. Unless otherwise required by law or agreed by the user, such adjustments shall not affect rights under a paid plan already purchased and still within its validity period.
3.6 If transaction information is inaccurate due to a system error, pricing-display error, quota-display error or other obvious error, HoiSum reserves the right, to the extent permitted by law, to correct the error and, as appropriate, cancel the transaction, issue a refund, compensate quota, extend the validity period or take other reasonable remedial action.
Section 4Refund policy
4.1 Refund eligibility, application method, processing time and circumstances under which no refund will be given for a paid plan shall be as set out in the refund policy, payment page or order-confirmation page displayed on the Platform at the time of purchase, and form part of these Terms. Where the Platform does not separately display refund rules for a particular paid plan, the default refund rules in this Section shall apply.
4.2 Within seven calendar days of purchasing a paid plan, if the user has not used any paid AI-tailoring quota, the user may apply for a refund; the refund amount shall be the amount paid less 5 % of the amount paid as a payment-processing and administrative fee, with the balance returned as described in these Terms.
4.3 Once the user has used any paid AI-tailoring quota — including but not limited to generating a tailored CV, cover letter, application email body or other paid generated content — the purchased paid plan is non-refundable, unless otherwise required by law or a major technical failure within HoiSum's reasonable control renders the Service unavailable.
4.4 If the user is unable to use a purchased service due to a major technical failure within HoiSum's reasonable control, HoiSum may, as appropriate, provide a fix, compensate quota, extend the validity period, issue a partial refund or a full refund.
4.5 Refunds are generally returned via the original payment channel. Actual arrival time may be affected by the processing times of the third-party payment provider, bank, card issuer or other financial institution.
4.6 To apply for a refund, please email [email protected] with your registered email address, date of purchase, order details and reason for the refund.
4.7 If HoiSum reasonably believes the user has abused the refund policy, made a bad-faith purchase, submitted duplicate refund requests or otherwise acted dishonestly, HoiSum reserves the right, to the extent permitted by law, to refuse the refund, restrict account features or take other reasonable measures.
Section 5AI-generated content
5.1 The Platform uses artificial-intelligence and automation technology to assist users with job-listing information organisation, CV processing, application-material drafting and application-pipeline management. AI-generated content is for reference only and cannot replace the user's own judgement.
5.2 AI-generated content includes, without limitation, job-parsing results, match scores, company-background summaries, CV suggestions, tailored CVs, cover letters, application email bodies and other text, analyses or suggestions generated or organised by the Platform.
5.3 AI-generated content may be inaccurate, incomplete, outdated, may misinterpret context, may omit important information or may not meet the requirements of a particular employer. Users are responsible for reviewing, verifying, modifying and confirming any AI-generated content before using, submitting or sending it externally.
5.4 HoiSum does not provide legal, immigration, professional-qualification, employment, tax, financial or other professional advice. No content generated by the Platform should be treated as such advice.
5.5 Users must not use the Platform to generate, produce, submit or disseminate any false, misleading, unlawful, infringing or improper application materials, including but not limited to fabricated academic qualifications, work experience, professional certifications, employment relationships, project achievements, referee details or salary information.
5.6 Users bear full responsibility for any content ultimately submitted to employers, recruitment platforms, educational institutions, government bodies or any third party. Users may not disclaim responsibility for the truthfulness, accuracy or legality of content on the basis that it was generated by HoiSum's AI.
5.7 AI-generated application materials are for the user's personal job-search purposes only. Without HoiSum's prior written consent, users may not use content generated by the Platform for commercial resale, ghostwriting services, bulk-generation services, training databases or any other purpose unrelated to personal job search.
5.8 HoiSum does not guarantee that AI-generated content will meet the requirements of any particular employer, recruitment platform, school, regulator or third party, nor that identical inputs will produce identical outputs at different times.
Section 6User content and personal data
6.1 For details on the collection, use, processing, retention, transfer, deletion of personal data and user rights, please refer to the Privacy Policy published on the Platform. By using the Service, you acknowledge that HoiSum will process personal data relating to the Service in accordance with the Privacy Policy.
6.2 Content uploaded, entered or submitted to the Platform by the user — including but not limited to CVs, personal information, educational background, work experience, job links, application materials, preference settings and other data — remains the user's own responsibility.
6.3 The user grants HoiSum a non-exclusive, worldwide, royalty-free, sub-licensable limited licence to process, store, reproduce, reformat, analyse, organise and generate outputs related to user content, to the extent necessary for providing, maintaining, securing, debugging and improving the Service. This licence is limited to what is reasonably necessary for providing and operating the Service.
6.4 HoiSum will not sell any user's personal data to any third party.
6.5 Unless expressly stated otherwise in the Privacy Policy or on the Platform interface and, where required by applicable law, with the user's consent, HoiSum will not use CVs, personal data or personal application materials uploaded by users to train third-party foundation models.
6.6 HoiSum may use third-party technology, infrastructure and service providers to the extent reasonably necessary for providing the Service, including but not limited to payment processing, identity verification, cloud hosting, AI technology, system security, data backup, email delivery and customer support. Personal-data processing arrangements with such providers are governed by the Privacy Policy.
6.7 Users may export their data from the Platform using the features provided. Users may also apply to delete their account and associated data via account settings or by contacting HoiSum. After account deletion, data will be handled in accordance with the Privacy Policy, applicable law and reasonable backup cycles.
Section 7Intellectual property
7.1 Intellectual property in original content uploaded to the Platform by the user — including CVs, personal data and application materials authored by the user — is retained by the user or the relevant rights holder.
7.2 Subject to these Terms, the user may use tailored application materials generated by the Platform for personal job-search purposes.
7.3 HoiSum and its licensors retain all rights, title and interest in and to the Platform and the Service, including but not limited to website and interface design, software, code, product workflows, data structures, templates, prompt configurations, workflows, branding, trademarks, logos, content arrangement and other technical or commercial work product. Rights in third-party technology, services, models, data or content are retained by their respective rights holders.
7.4 Users may not reverse-engineer, decompile, disassemble, crack, bypass restrictions, scrape data, bulk-download, replicate the Platform's architecture, extract prompt configurations or otherwise attempt to obtain non-public portions, technical logic, data structures or trade secrets of the Platform.
7.5 If a user provides comments, suggestions, bug reports, feature ideas or other feedback to HoiSum, HoiSum may use such feedback without payment to the user for the purpose of improving, developing and promoting the Service; however, HoiSum does not thereby acquire ownership of the user's original CV or personal data.
Section 8User responsibilities and prohibited conduct
8.1 Users shall use the Service lawfully, honestly and in compliance with these Terms, and shall ensure that content they submit, upload, generate, save, download or send externally does not violate any applicable law, third-party right or Platform rule.
8.2 Users shall provide truthful, accurate, complete and up-to-date personal and job-search information. The user bears sole responsibility for any consequences arising from false, outdated, incomplete or misleading information.
8.3 Users must not engage in any of the following:
- using the Service for any unlawful, fraudulent, infringing, misleading, harassing, discriminatory, defamatory or improper purpose;
- using automated tools, scripts, bots, crawlers, bulk requests or other abnormal means to access, operate, test or extract data from the Platform;
- interfering with, disrupting, overloading, scanning, probing or attempting to bypass the Platform, its networks, systems, security measures or usage limits;
- sharing, renting, selling, transferring or otherwise permitting others to use the user's account or paid entitlements;
- using the Service or its generated content for commercial ghostwriting, bulk-application services, recruitment services, database construction, model training, competitive analysis or other unauthorised purposes;
- uploading or transmitting viruses, malicious code, spam, unauthorised advertising or other content that may harm the Platform, users or third parties;
- infringing HoiSum's, other users' or any third party's intellectual-property rights, privacy rights, reputation rights, trade secrets or other legal rights;
- circumventing or attempting to circumvent the Platform's payment arrangements, refund policy, quota limits, account restrictions or security measures.
8.4 If a user breaches these Terms, HoiSum reserves the right, to the extent permitted by law, to suspend or terminate the account, refuse to provide the Service, delete relevant content, cancel quotas, refuse a refund and pursue legal remedies.
Section 9Third-party services and external links
9.1 The Service may incorporate or rely on third-party websites, services, content, data, APIs or payment, sign-in, cloud, AI, email and security services. Such third-party services are provided by the respective third parties and may be subject to their own terms, privacy policies and rules.
9.2 HoiSum does not control third-party websites, recruitment platforms, employer websites, job-listing data or third-party services, and assumes no responsibility for their accuracy, legality, availability, security, policy changes or service interruptions.
9.3 When using third-party websites or services, users should review and comply with the relevant third-party terms and policies. Any transactions, communications, disputes, losses or liabilities arising from third-party websites, data or services shall be resolved between the user and the relevant third party.
Section 10Service availability, maintenance and changes
10.1 HoiSum will use reasonable efforts to maintain the availability and security of the Service but does not guarantee that the Service will be uninterrupted, error-free, fully secure or always available.
10.2 The Service may be temporarily interrupted or limited due to scheduled maintenance, system upgrades, troubleshooting, security patches, capacity adjustments or other operational reasons. HoiSum will provide advance or timely notice where reasonably practicable.
10.3 Users on the free plan are not entitled to any service-level agreement or service-availability commitment.
10.4 HoiSum shall not be liable for service interruptions, data delays, data loss or feature unavailability caused by force majeure, third-party service outages, network-infrastructure failures, cloud-service failures, government action, changes in law or policy, natural disasters, war, epidemics, strikes, power outages, cyberattacks or other causes beyond HoiSum's reasonable control, except where otherwise required by law.
10.5 HoiSum may from time to time add, modify, suspend or discontinue certain features of the Service. Except where required by law or necessitated by security, compliance or significant technical reasons, such changes shall not materially diminish the core entitlements of a paid plan already purchased and still within its validity period.
Section 11Disclaimer
11.1 To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. HoiSum makes no express, implied or statutory warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, uninterrupted operation, error-free operation, non-infringement or suitability for the user's specific objectives.
11.2 HoiSum does not warrant and shall not be liable for the following, except where otherwise required by law:
- the user's failure to obtain interviews, job offers, visas, employment opportunities or any particular job-search outcome;
- inaccuracies, incompleteness, outdatedness, errors or omissions in AI-generated content, job parsing, match scores, company-background summaries or other Platform outputs;
- failures, interruptions, delays, policy changes or data errors of third-party websites, recruitment platforms, employers, payment services, sign-in services, cloud services, AI technology or other third-party services;
- any consequences arising from the user's direct use of AI-generated content that has not been reviewed, verified or modified;
- any losses, claims, investigations or disputes resulting from the user's breach of these Terms, third-party terms or applicable law.
11.3 Nothing in these Terms excludes or limits any user right that may not be excluded or limited under applicable law.
Section 12Limitation of liability
12.1 To the fullest extent permitted by law, HoiSum and its directors, officers, employees, contractors, agents, service providers and licensors shall not be liable for any indirect, incidental, special, punitive or consequential damages, or for loss of profits, loss of goodwill, loss of data, business interruption, cost of substitute services or other similar losses, whether based on contract, tort, negligence, statutory liability or any other legal theory.
12.2 To the fullest extent permitted by law, HoiSum's aggregate liability to the user in connection with the Service shall not exceed the total amount the user actually paid to HoiSum for the Service in the twelve months preceding the claim.
12.3 This Section does not exclude or limit any liability that may not be excluded or limited under applicable law, including but not limited to liability for fraud, wilful misconduct, gross negligence, death or personal injury.
Section 13Termination and account deletion
13.1 Users may stop using the Service at any time and may apply to delete their account via the features provided on the Platform or by contacting HoiSum.
13.2 If a user breaches these Terms, other applicable policies, third-party rights or applicable law, or if HoiSum reasonably believes that continued provision of the Service may pose a security, legal, commercial or compliance risk, HoiSum may suspend, restrict or terminate the user's access to the Service to the extent permitted by law.
13.3 Upon termination or deletion of an account, the user's right to use the Service terminates. Unless otherwise provided by the refund policy, Platform pages or applicable law, account termination or deletion does not automatically give rise to a right to a refund.
13.4 Provisions of these Terms that by their nature should survive termination shall continue in effect after the Service is terminated, the account is deleted or these Terms are terminated, including but not limited to intellectual-property, user-responsibility, disclaimer, limitation-of-liability, governing-law and dispute-resolution provisions.
Section 14Changes to these Terms
14.1 HoiSum may amend these Terms from time to time to reflect service updates, legal requirements, commercial arrangements, risk management or other reasonable grounds.
14.2 General amendments take effect upon publication on the Platform. Amendments affecting material user rights — including but not limited to payment arrangements, refund policy, core feature scope, significant liability limitations or material changes to personal-data processing — will be notified in advance via Platform notice, email or other reasonable means and take effect from the date specified in the notice.
14.3 Unless otherwise required by law or agreed by the user, amendments shall not affect the core entitlements of a paid plan already purchased and still within its validity period at the time the amendment takes effect.
14.4 Continued use of the Service after an amendment constitutes acceptance of the amended Terms. If you do not agree with the amended Terms, you should stop using the Service and may apply to delete your account via the means provided on the Platform.
Section 15Governing law and dispute resolution
15.1 These Terms are governed by and shall be construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict-of-law rules.
15.2 Any dispute arising out of or in connection with these Terms or the Service shall first be resolved through good-faith negotiation between the parties.
15.3 If negotiation fails, either party may submit the dispute to a court of competent jurisdiction in the Hong Kong SAR. Both parties agree to submit to the non-exclusive jurisdiction of the courts of the Hong Kong SAR.

Section 17Language
The Traditional Chinese version of these Terms is the authoritative version. Where an English, Simplified Chinese or other language version exists and there is any inconsistency or ambiguity between versions, the Traditional Chinese version shall prevail unless otherwise required by applicable law.
